Waiver for recreational use of Lake Lahr

Columbia Land Conservancy, Inc. (“CLC”) owns the Taghkanic Community Forest (“TCF”), which contains a body of water called Lake Lahr. CLC will provide members of the public, at no charge and for recreational purposes only, canoe(s), kayak(s), and other recreational water equipment (collectively referred to as “TCF Water Equipment”) to be used solely on Lake Lahr.

I understand that by using Lake Lahr, its dock, and the TCF Water Equipment, I, and any minors of whom I am the parent, legal guardian, or supervising adult (my “Minors”), may be exposed to a variety of hazards and risks, foreseen and unforeseen, including but not limited to bodily injury, disease, serious disability, or even death. I appreciate that I may have to exercise extra care for my own person and for others around me, including any Minors of mine, in the face of such hazards and risks.  I agree to read, listen to, and follow all safety instructions, rules, and regulations, and ensure that any Minors of mine do the same.

In consideration of being allowed to use Lake Lahr, its dock, and the TCF Water Equipment, I knowingly and freely assume all risks, both known and unknown, including but not limited to bodily injury, disease, serious disability, or even death, associated with such use, and assume full responsibility for my, and any of my Minors’, use and I willingly agree to comply with the rules and regulations for such use and ensure my Minors do the same. I also agree to exercise common sense and follow all safety precautions to avoid accident or injury and ensure that any Minors of mine do the same.

I, for myself and my Minors (if any), and on behalf of our heirs, assigns, personal representatives and next of kin, hereby agree to indemnify and hold harmless CLC and its representing agencies, employees, board members, contractors, volunteers, and other representatives (together, the “CLC parties”) against any liability, claim, damages or injury, whether of persons or property, death, or costs, including attorney fees, arising from or resulting from use of Lake Lahr, its dock and the TCF Water Equipment by me or any Minors of mine.

I understand that, in the event of an injury, there may not be rescue or medical facilities immediately available for injuries that I, or any Minors of mine, may suffer from the hazards and risks to which I/they may be exposed, and I agree that I am responsible for my/their own medical care.  However, if I/they do receive medical care in the event of such injury, I, on behalf of myself and any Minors of mine, release the CLC parties from any and all claims resulting from any first aid, treatment, or services rendered. I understand that CLC does not provide any health, medical, or disability insurance for users of Lake Lahr, its dock, and the TLC Water Equipment.

I hereby grant and convey unto CLC, on behalf of myself and any Minors of mine, all rights, title and interest in and to any and all photographic images and video or audio recordings taken of or shared by me and any Minors of mine (together, “Recordings”), I consent to cropping and other alteration of the Recordings including those in which I or a Minor of mine appears, and I consent to use of the Recordings in publications, including websites or other electronic forms or media, and to other use or distribution of the Recordings in whole or in part in all manners and media, including for advertising, trade, promotional and other related lawful purposes without notifying me or providing further consideration, attribution, or credit.

I agree if any part of this Waiver is determined to be unenforceable, it is intended that all other terms shall be enforced.

FOR PARTICIPANTS OF MINOR AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION) This is to certify that I, as parent/legal guardian with legal responsibility for or supervising adult of this participant(s), do consent and agree to their release, of all the CLC parties as provided above, and, for myself, my Minor(s), our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the CLC parties from any and all liabilities incident to my Minor’s involvement or participation in these activities as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE CLC PARTIES, to the fullest extent permitted by law. I further agree to the photographic and video rights grant and release set forth above.
